The present conditions govern the sale of all the products presented on the Internet site of the company DEB’S BISTRO.

The parties agree that their relations will be exclusively governed by this contract.

 

DEB’S BISTRO reserves the right to adapt or modify these conditions at any time. In case of modification, the conditions in force on the date of this order will be applied to each order.

 

If a condition were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector, and this in accordance with French law which will be the only applicable one.

 

The Client must be:

- either a natural person over 18 years of age and having full legal capacity to contract

- either a natural person under the age of 18 emancipated 

Article 2: Purpose
  1. These conditions are intended to define all the terms of sale, in particular the order, payment and delivery between DEB’S BISTRO and the Customer.

  2. These conditions express all the obligations of the parties.

Article 3: Orders

The Customer who wishes to purchase one or more items on the DEB’S BISTRO website must comply with the following process:

He selects the product (s) he wishes to acquire by adding the product to the basket.

After having checked his selection (size, color, price…), and indicated his possible reduction code in the field provided for this purpose on the Basket page, he validates the choice of the selected product (s) by clicking on Continue.

The Client must then:

- If he is already a DEB’S BISTRO Customer: complete the form, indicating only his email address and password communicated during his first order

- If he is a new DEB’S BISTRO Customer: complete the form indicating his name, first name, contact details, email address, password ... The Customer is free to modify his personal information at any time in "My Account".

The Customer chooses his carrier from the list offered to him.

Finally, the Customer chooses his method of payment from the list offered to him. He then accesses a payment page and fills in the STRIPE secure payment form to finalize his order.

When the order is finalized, DEB’S BISTRO confirms the order to the Customer by sending him a summary email.

 

DEB’S BISTRO disclaims all liability in the event of a dispute between the Customer and the company "STRIPE". DEB’S BISTRO reserves the right to refuse any order from a Customer with whom a dispute relating to the payment of a previous order has already been noted and not resolved.

 

Any order placed on the site www.debsbistro.com implies acceptance of these conditions, price and description of products. DEB’S BISTRO undertakes to honor any order placed on the online store. In the case of one or more items unavailable in the order, DEB’S BISTRO undertakes to notify the Customer as soon as possible and, if the total amount of the order has been debited, to reimburse the Customer for the amount of the missing items either by crediting the Customer's account for a credit note to be used on their next order, or, if the Customer requests it, by re-crediting their bank account with this amount.

Article 4: Price

The price of the products is displayed in euros excluding tax. VAT is included in the total price invoiced at the rate in force in France for the products concerned.

DEB’S BISTRO reserves the right to modify its prices at any time without notice. The items will be invoiced on the basis of the prices in force at the time of validation of the order by the Customer

Article 5: Product Catalog

DEB’S BISTRO guarantees the authenticity of the products it offers for sale.

 

DEB’S BISTRO undertakes to notify by email or telephone any customer who has ordered an unavailable product.

 

The products offered for sale are presented and detailed with the greatest possible precision. In a permanent concern to improve the description of the offer, DEB’S BISTRO may need to modify or add characteristics to the product descriptions.

 

If the Customer notices any anomaly on the product sheets, he is invited by DEB’S BISTRO to let him know so that it can be corrected as quickly as possible.

Article 6: payment

Once the basket has been validated and the delivery method chosen, DEB’S BISTRO offers the Customer a 100% secure payment with STRIPE or with the HSBC payment platform using Visa or Mastercard:

 

1. With STRIPE, the Customer can pay in two different ways:

The Customer can pay with his payment card. The STRIPE service gives the possibility of paying via various payment cards:

With STRIPE, the Customer's credit card number is in no way transmitted to the DEB’S BISTRO company and each purchase is confirmed by a receipt.

 

2. Payment via the secure HSBC platform: 

DEB’S BISTRO accepts credit and debit cards (Mastercard and Visa) to process payment. The customer expressly acknowledges that the disclosure of his bank card number confers on DEB’S BISTRO the authorization to debit his account for the amount of the order. Once the payment is initiated by the customer, the transaction is immediately debited after verification of the information. The customer confirms that he is the legal holder of the card to be debited and that he is legally authorized to use it. In the event of an unsuccessful transaction, a notice of the cancellation of the order for payment error is sent to the customer by DEB’S BISTRO to the email address registered by the customer.

The data recorded and kept by DEB’S BISTRO constitute proof of the order and of all previous transactions. The data recorded by HSBC constitutes proof of financial transactions. DEB’S BISTRO will never keep the details of the customer's payment card.

This transaction system is valid for all payment amounts in all countries delivered by DEB’S BISTRO.

The products remain the property of DEB’S BISTRO until full payment of the order.

Article 7: delivery

1. Delivery by Colissimo / Chronopost

Each package has a bar code which is available to the Customer. When the order is dispatched, this number is sent by email to the Customer to enable him to follow the dispatch of the latter on the sites of the carriers concerned.

The package is delivered by La Poste to the delivery address defined by the Customer. This delivery method is valid for the whole world.

The delivery time is 3 to 8 working days except in cases of force majeure from the date of shipment. Usually observed delay.

takeawayand return to the store are free. You can pick up your order from Monday to Saturday from 11:30 am to 7:30 pm by providing your order number. Allow 3 working days between the order date and the date of delivery to the store. As soon as your order arrives, we will inform you by e-mail.

Article 8: Withdrawal / Return / Exchange / Refund

The Customer can return, at his expense and by colissimo signature, to DEB’S BISTRO, the products received within seven days of the date of receipt (the postmark being taken as proof). Products must be returned in their original packaging and condition. He may then be fully reimbursed for the amount of the items shipped or will benefit from a credit note (valid for one year) which can be used for his next order on the website only, within the limit of available stocks. In the event of receipt of a damaged or non-compliant item, the customer must report it to customer service on the day of receipt of the package.

Article 9: Personal data and protection of privacy

DEB’S BISTRO reserves the right to collect data on the Customer, in particular by the use of cookies in accordance with the legislation in force. The Customer is informed that this computerized data processing has been declared to the CNIL under number 1533304.

 

In accordance with the law n ° 78-17 of January 6, 1978 “Data processing and Freedoms”, the Customer benefits from a right of access, rectification and deletion of the data concerning him recorded by DEB’S BISTRO.

 

The Customer can contact DEB’S BISTRO at any time and oppose the commercial use of his personal data recorded by DEB’S BISTRO.

 

If he has validated the option "Receive offers from partners", the Customer may be required to receive offers from our partners. He of course has the right to modify his customer account, and the right to unsubscribe via our unsubscribe form in each of our newsletters.

 
Article 10 : Services

The Sales department is available to the Customer by e-mail ( debsbistroindien@gmail.com ) or chat in website page www.debsbistro.com   from Monday to Friday 10h00 to 18h00 .

Article 11: Liability / Litigation

DEB’S BISTRO is subject to an obligation of means vis-à-vis the Customer. It is expressly agreed that any disruption in the provision of the service for any reason whatsoever, any external intrusion or infection by a computer virus, cannot engage the responsibility of DEB’S BISTRO.

 

DEB’S BISTRO cannot be held responsible for any malfunction of the postal services or other delivery service providers.

 

The Customer is responsible for the accuracy of the information, given by himself when ordering, relating to his delivery address, billing address, email address, telephone number. DEB’S BISTRO cannot be held responsible for the consequences of any error in this information. All costs inherent to these consequences would be the responsibility of the Customer.

 

If a Customer is dissatisfied for any reason whatsoever, he cannot claim any compensation other than the reimbursement of his order.

In the event of a dispute, the French courts will have sole jurisdiction.

Article 12: Intellectual property

All the elements of the Site (photographs, illustrations, pictograms, and descriptions, logo, brand) are and remain the intellectual and exclusive property of DEB’S BISTRO
